When divorcing, it is important to consider obtaining a Consent Order even if there are little or no assets. People don’t realise that spouses remain financially linked to each other after a Divorce has been finalised.
This means that either party can make a claim against the other at any time, which could include assets accrued after the Divorce itself.
However, this can be easily prevented by filing a Consent Order in order to achieve what is known as a clean break, which will prevent any claims being made in the future.
