No Win No Fee Solicitors Manchester

Concerns about legal costs should be addressed before you begin a personal injury claim. Speak to MWG Solicitors in Manchester about whether no win no fee funding may be available for your case and what the proposed terms would mean for you.

What does no win no fee mean?

A conditional fee agreement links payment of specified legal fees to the outcome of a claim. Availability depends on assessment of the case and agreement of the written terms. It is not a guarantee that every claim will be accepted or that every possible cost is covered. Before instructing a solicitor, ask what counts as success, which fees the agreement covers and what could remain payable. GOV.UK outlines using a solicitor for an injury claim.

What might be deducted if the claim succeeds?

The agreement may provide for a success fee, and there may be insurance premiums or expenses to consider. Ask for a clear explanation of the total potential deductions and a worked example of how they would affect your compensation. For personal injury claims at first instance in England and Wales, the statutory cap on a CFA success fee is generally 25% of the specified categories of damages, excluding future financial losses and subject to the legislation. It is not a blanket cap on every possible deduction. The Conditional Fee Agreements Order sets out the rule.

What if the claim is unsuccessful?

Ask which expenses, insurance premiums or other liabilities could remain payable. Also ask about the consequences of ending the agreement early, failing to cooperate or rejecting settlement advice. The wording of the agreement and any insurance policy matters. Insurance may provide protection against specified costs, subject to its terms and exclusions. Do not assume that the phrase “no win no fee” removes all financial risk.

Check existing cover before agreeing funding

Legal expenses cover may already be included with a household, motor or other insurance policy. Trade union support or other arrangements may also be relevant. Tell the team about any existing cover so the available options can be considered.
  • Ask for the agreement and costs information in writing.
  • Check the success fee and other possible deductions.
  • Understand insurance cover and exclusions.
  • Ask what happens if the case ends early.
  • Keep a copy of the agreed terms.
